2 Scope of this policy
It applies to visits to this website (fahriom.de and related language versions) and to enquiries you send us via this website, by email or by phone.
For data processed in a restaurant’s Fahriom workspace — orders, delivery addresses, driver locations, shift and remittance data — AK Software GmbH is not the controller under the GDPR; the restaurant is. We process that data solely on the restaurant’s instructions. Section 7 explains this in more detail.
3 Your rights
You have the following rights regarding your personal data:
- Access to whether and which data we process (Art. 15 GDPR)
- Rectification of inaccurate data (Art. 16 GDPR)
- Erasure, unless a legal retention duty applies (Art. 17 GDPR)
- Restriction of processing (Art. 18 GDPR)
- Data portability in a common format (Art. 20 GDPR)
- Objection to processing based on legitimate interest (Art. 21 GDPR)
- Withdrawal of consent with effect for the future (Art. 7 (3) GDPR)
An email to [email protected] is sufficient.
You may also lodge a complaint with a supervisory authority (Art. 77 GDPR). For us this is the Berlin Commissioner for Data Protection and Freedom of Information, Alt-Moabit 59–61, 10555 Berlin, Germany.
4 Hosting and server logs
This website and the Fahriom application are hosted with a professional cloud provider in the European Union or in a country with an adequate level of data protection. A data processing agreement under Art. 28 GDPR is in place with the hosting provider.
When you open a page the server automatically records:
• IP address of the requesting device
• date and time of access
• page requested and volume of data transferred
• referrer URL, browser type and operating system
Purpose: delivery of the site, operational security and defence against attacks. Legal basis: Art. 6 (1)(f) GDPR — our legitimate interest in a stable and secure service. Retention: usually 30 days.
5 Cookies and sessions
We set technically necessary cookies and session data without consent, as permitted by § 25 (2) no. 2 TDDDG. They make the site and forms work (e.g. contact form, CSRF protection, locale).
We currently do not use analytics or advertising cookies. If we introduce optional statistics or marketing technologies later, we will only do so after your consent (§ 25 (1) TDDDG, Art. 6 (1)(a) GDPR).
6 Contact enquiries
If you contact us via the form, email or phone, we process the data you provide (name, restaurant, email, phone, message) to answer your enquiry.
Legal basis: Art. 6 (1)(b) GDPR (pre-contractual steps) or Art. 6 (1)(f) GDPR (legitimate interest in answering enquiries). Retention: until your enquiry is fully handled, then deletion or archiving where statutory retention applies.
7 The Fahriom system
Dispatch, live map, driver app, POS embeds and remittance process operational and sometimes guest data. The role split matters:

- data processing agreement under Art. 28 GDPR
We process this data only on instructions and not for our own purposes. Anyone who wants to know what happens to order or delivery data should contact the restaurant where they ordered — that restaurant’s privacy notice applies.
Typical data: order and delivery details, promised times, driver master data (name, phone), shift and GPS data during active tours, proof photos and cash-on-delivery confirmations, remittance figures per shift.
Retention: the restaurant sets the periods. Where tax or commercial retention duties apply, data cannot be deleted early.
8 Security
This website is delivered over HTTPS; the connection is TLS-encrypted. You can see this from the lock icon in your browser’s address bar.
Please note that data transmission on the internet, for example by email, can have security gaps. Complete protection against access by third parties is not possible.

We update this policy when our services or the law change. The version published here applies. The date above shows the current status.
